DMCA Notice

KiddyDo respects the intellectual property rights of others. If you believe content on KiddyDo infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) by contacting our designated agent.

Designated Agent

TODO: insert the registered agent block returned by CopyByte (or the equivalent service) once registration with the U.S. Copyright Office is confirmed. Block must include:

  • Name of the designated agent
  • Mailing address (virtual office, registered with KiddyDo LLC)
  • Telephone number
  • Email address (typically dmca@kiddydo.com or the agent service’s inbox)

What your notice must include

For a notice to be effective under the DMCA, it must include all of the following (17 U.S.C. § 512(c)(3)):

  1. Your physical or electronic signature (or that of someone authorized to act on your behalf).
  2. Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are involved.
  3. Identification of the material on KiddyDo you claim is infringing, with enough detail (URL, listing ID) for us to locate it.
  4. Your contact information — address, telephone number, email.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

Counter-notice

If you believe content of yours was removed in error, you may submit a counter-notice to the same designated agent. The counter-notice must include the elements set out in 17 U.S.C. § 512(g)(3), including your consent to jurisdiction in the federal court for your address (or, if outside the United States, in any judicial district where KiddyDo may be found).

Repeat infringers

Per § 512(i), KiddyDo terminates accounts of users we determine to be repeat infringers in appropriate circumstances.

False notices

Submitting a misrepresentation in a DMCA notice or counter-notice may subject you to liability for damages, costs, and attorneys’ fees under § 512(f).
